You are agreeing to the coaching package as described on the website.
Gentle Potty Coaching. The purpose of the initial consultation session is to gather background information, determine appropriate and realistic goals for the family and/or child, and create an action plan with a specific timeline/schedule. To this end, the Client will be requested to provide information about the child’s developmental history as well as daily routines and schedule. This information will be used to establish an agreed-upon plan to progress towards the previously agreed-upon goal. The initial session will meet via Zoom (or other conferencing software).
Confidentiality. Groove Parenting shall maintain the confidentiality of the Client's information in accordance with applicable laws and professional standards. You understand there are circumstances where I may be required by law to disclose information (for example, court order) and if that occurs, you release me from this obligation, only for the information I am required to disclose.
Both Parties acknowledge and agree that any information, proprietary or otherwise, relating to the other party’s business which is not known to the public is to remain strictly confidential. Neither party will disclose such information to third parties without prior written consent. The personal, business, and operating practices of both parties shall not be made public by either party on any website, online forum, social networking site, message board, or any other public media without the express, written consent of both Parties.
Non-medical Advice. Client acknowledges that Elizabeth Lowy, as activint provider for Groove Parenting is not a medical professional and, thus, cannot and will not advise as to medical conditions nor make medical diagnoses.
Client is solely responsible for discussing any possible medical conditions with your child’s physician or other health professional.
Limitation of Liability. Groove Parenting shall not be liable for any damages resulting from the provision of services or the failure to provide services, except in cases of gross negligence or willful misconduct. Furthermore, Groove Parenting and its respective owner(s), officer(s), manager(s), any employee(s), contractor(s) and/or agent(s) shall not be liable for any injuries, contraction of COVID-19 and/or other pathogens, loss, liability, claims, damages, or costs, including court costs and attorney’s fees, that may be sought against Groove Parenting due to participating in any program through Groove Parenting
Payment. Fee for services is as listed on online checkout page. Groove Parenting accepts cash, Zelle, and credit cards. Payment is processed electronically via a secure processor when Client selects the services requested. Any issues with payment should be communicated to Elizabeth Lowy via e-mail immediately at [email protected].
Additional services may be agreed upon by the Parties and separate payment shall be provided for said additional services.
Refund and Cancellation Policy. Client acknowledges that due to the nature of the services provided, no refunds can be made. If Client has concerns about the services rendered during the time in which services are being provided, Client agrees to communicate directly with Elizabeth Lowy via e-mail and provide Groove Parenting a reasonable opportunity to address the concerns.
If Client decides to cancel or reschedule the initial consultation, Client agrees to notify Groove Parenting at least one business day in advance.
Insurance. Groove Parenting does not accept insurance.
Governing Law. This Agreement shall be governed by and construed in accordance with the laws of New York State.
Entire Agreement. This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, whether oral or written.
Severability. If any provision of this Agreement is held invalid or unenforceable by any court of competent jurisdiction, arbitrator or mediator, then the other provisions of this Agreement shall remain in full force and effect.
